Privacy notice
Last updated 4 November 2026. This notice explains how Nightshift Technologies handles personal information about visitors to this site and people who contact us, under the Protection of Personal Information Act 4 of 2013 (POPIA).
Who we are
Nightshift Technologies (Pty) Ltd, registration 2026/678201/07, Cape Town, South Africa, is the responsible party for the personal information described here. Contact us at [email protected] or 078 143 9199.
Information Officer
Jared De Kock. Write to [email protected] about anything in this notice.
What we collect and why
This site sets no cookies and runs no analytics or advertising trackers. It has no sign-up forms and adds no one to a mailing list. We collect only what you choose to send us when you email us, message us on WhatsApp or book a call:
- your name, email address, phone number and the business you work for
- what you tell us about the job you would like off your desk, and times that suit you
- our correspondence with you
We use it to reply to you, to set up and hold the free call, to write your one-page outline and, if you go ahead, to prepare the agreement and invoices. Giving it is voluntary, but without a name and a way to reach you we cannot reply or set up the call.
When you open a page, our website host processes technical data such as your IP address and browser type to deliver the page and keep the site secure.
Lawful basis
We process this information because it is needed to take the steps you ask for before an agreement and, if you go ahead, to carry out the agreement (POPIA section 11(1)(b)); because the law requires us to keep business and tax records (section 11(1)(c)); and for our legitimate interest in answering business enquiries (section 11(1)(f)). For direct marketing we rely on your consent (section 69).
Who we share it with
We do not sell or rent your personal information. We share it only with the service providers that run our business tools and process it for us as operators, and only as far as they need to:
- our email provider
- Google, for the booking calendar. When you book a call online, Google's privacy policy also applies to that booking
- WhatsApp (Meta), if you message us there
- our website hosting provider
We also disclose personal information where the law requires it.
Information sent outside South Africa
Some of these providers store or process information outside South Africa. We send it only as POPIA section 72 allows: where the provider is subject to a law, binding corporate rules or a binding agreement that gives adequate protection, where you consent, or where the transfer is needed to answer your request or carry out an agreement with you.
How long we keep it
We keep enquiries and correspondence for as long as we need them to answer you and to work with you. If you become a client, we keep the agreement, invoices and the records that support them for as long as tax and company law require. After that, we delete them or remove what identifies you.
Security
We protect personal information with reasonable technical and organisational measures, as POPIA section 19 requires. We never ask for passwords by email or WhatsApp. If we believe your personal information has been accessed or acquired by someone without authority, we will tell you and the Information Regulator, as POPIA section 22 requires.
Direct marketing
We send direct marketing only with your consent. If we have not dealt with you before, our first email only asks whether you agree to hear from us, and says how to decline. Every message after that says how to opt out, and we honour every opt-out.
Your rights
You have the right to:
- ask whether we hold personal information about you, and for a copy of it (section 23)
- ask us to correct or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully, or that we are no longer allowed to keep (section 24)
- object to our processing it, including for direct marketing (section 11(3))
- withdraw your consent at any time, where we rely on it
- complain to the Information Regulator (section 74)
To use any of these rights, email [email protected]. We may first need to confirm who you are.
The Information Regulator
If you are not satisfied with how we handle your personal information, you may complain to the Information Regulator (South Africa) through its eServices portal at inforegulator.org.za, or contact it at [email protected], 010 023 5200 (toll-free 0800 017 160), Woodmead North Office Park, 54 Maxwell Drive, Woodmead, Johannesburg.
When we build for a client
When we build a system for a client, the client is the responsible party for its own customers' personal information. We act only as the client's operator, under a written agreement, and process that information only on the client's instructions. Client data stays in the client's accounts and is never used to train any model. If your question is about a business we build for, ask that business first.
Changes to this notice
We will post any change on this page, with a new date at the top.
